1. Agreement to these terms
These Terms and Conditions govern your access to and use of OccasionPost, including its websites, applications, campaign tools, AI-assisted features, and related services (the "Service"). By creating an account or using the Service, you agree to these terms and our Privacy Policy.
If you use the Service for an organization, you represent that you have authority to accept these terms on its behalf.
2. Accounts and eligibility
You must be legally able to enter into a binding agreement and provide accurate, current account information. You are responsible for activity under your account and for keeping your credentials secure.
- Notify us promptly if you suspect unauthorized access.
- Do not share access outside your authorized team.
- You are responsible for ensuring that your users comply with these terms.
3. The Service
OccasionPost helps users identify relevant occasions, generate campaign materials, manage approvals, and publish or export content. Features may rely on third-party AI, storage, billing, email, and social platform providers.
Recommendations, generated materials, dates, translations, and scheduling suggestions may contain errors. You are responsible for reviewing content for accuracy, cultural suitability, legal compliance, and brand fit before use or publication.
4. Your content and generated output
You retain ownership of content you submit to the Service. You grant us a limited license to host, process, reproduce, and transform that content only as needed to provide, secure, and improve the Service.
Subject to applicable law and third-party terms, you may use output generated for your account. You are responsible for confirming that your inputs and intended use do not infringe intellectual property, privacy, publicity, or other rights. Similar or identical output may be generated for other users.
5. Acceptable use
You may not use the Service to:
- Break the law, violate another person's rights, or create deceptive or harmful content.
- Upload content you do not have permission to use.
- Impersonate a person without authorization or use identity features without valid consent.
- Probe, disrupt, reverse engineer, or bypass security or usage controls.
- Distribute malware, spam, or content that exploits minors.
- Use generated content without required disclosures, permissions, or human review.
We may remove content or restrict access when reasonably necessary to protect users, third parties, or the Service.
6. Subscriptions, credits, and payment
Paid plans renew for the billing period shown at checkout unless canceled before renewal. Prices, taxes, included usage, and credit costs are presented before purchase and may vary by plan or provider.
Credits are Service units, not money, and cannot be transferred or redeemed for cash. Except where required by law or stated at purchase, payments and consumed credits are non-refundable. You remain responsible for charges incurred before cancellation.
7. Third-party services
The Service may connect to third-party platforms. Their terms, policies, availability, and technical limits apply to your use of those integrations. We are not responsible for changes, suspensions, content decisions, or outages controlled by those providers.
8. Availability and disclaimers
We may change, suspend, or discontinue features and may impose reasonable usage limits. We do not guarantee uninterrupted availability, publication at an exact time, or any particular business, engagement, or revenue result.
To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, or error-free operation.
9. Limitation of liability
To the fullest extent permitted by law, OccasionPost will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the Service. Our total liability will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Suspension and termination
You may stop using the Service or cancel your plan at any time. We may suspend or terminate access if you materially breach these terms, create risk or legal exposure, fail to pay, or misuse the Service.
Where practical, we will provide notice and an opportunity to export your data. Provisions that by their nature should survive termination will remain in effect.
11. Changes and contact
We may update these terms to reflect changes to the Service, law, or our business. We will post the revised terms and update the effective date. If a material change requires notice or consent, we will provide it as required by law.
